Casey County Deputy Austin Harris was conducting routine traffic observation at the intersection of KY 49 and KY 1547, when a 2009 KIA Amanti made a sudden and reckless turn onto KY 1547, crossing into oncoming traffic. The driver, upon spotting the patrol vehicle, swerved back into the correct lane, visibly startled.
Deputy Harris attempted a traffic stop, but the driver initially failed to stop, tossing a small bag out the passenger side window before finally stopping a short distance away. The driver, 41-year-old Eric L. Terry, exhibited signs of nervousness.
When questioned, Eric claimed he had just finished weed-eating and was eager to get home. Eric admitted to discarding a bag of marijuana. Deputy Harris escorted him back to the location where he had thrown the bag, only to discover that it contained something more potent: a clear zip-lock bag filled with white, crystal-like rocks. Eric confessed that it was methamphetamine and apologized for initially misleading the officer.
Further search revealed a small tub wrapped in aluminum foil in Eric’s pockets. When asked about his recent meth use, Eric admitted to using it approximately three hours prior. Additionally, he disclosed the presence of a joint in the car’s cup holder.
Deputy Harris conducted field sobriety tests, which Eric failed. Mr. Terry was arrested and transported to the hospital for a blood test. Charges include: Possession of Marijuana, Reckless Driving, Tampering with Physical Evidence, No Operator’s License, No Insurance (second offense), Possession of Methamphetamine (first degree, second offense), Possession of Drug Paraphernalia, No Tail Lights, and DUI (controlled substance, third offense). He was taken to the Casey County Jail.
